    The legislation aims to secure a stable U.S. supply of high-performance chips for AI workloads, giving priority to companies building cloud and data-center capacity. Amazon, Microsoft, and AI developer Anthropic have endorsed the bill’s “trusted entities” provision, which would allow select firms to receive export exemptions without government licensing. Backers argue this carve-out would streamline global operations for key AI players while strengthening America’s AI infrastructure and competitiveness.

    Nvidia, which holds roughly 80% of the AI chip market, is pushing back. The company has spent about $3.5 million this year lobbying against the proposal, warning it could distort global semiconductor markets and prompt even tighter U.S. export controls. The Gain AI Act has support from senior Democrats, including Senate Majority Leader Chuck Schumer, and could be folded into the National Defense Authorization Act before year-end. However, it still requires backing from Senate and House Republicans and faces reservations from some White House officials. Proponents say the bill is critical to preventing future chip shortages and reinforcing U.S. leadership in AI.
