On February 23, 2023, the White House commenced an in-depth review of a newly proposed Internal Revenue Service (IRS) rule aimed at regulating and taxing American-held cryptocurrency accounts in foreign countries. Historically, under the Foreign Account Tax Compliance Act (FATCA) and the Report of Foreign Bank and Financial Accounts (FBAR), U.S. citizens and residents are required to report foreign financial accounts and assets that exceed certain thresholds. However, these regulations have lagged in adequately capturing the dynamics of cryptocurrencies and other digital assets, like non-fungible tokens (NFTs).

Under this rule, American taxpayers would be required to report these assets if their total value exceeds $10,000 at any point during the calendar year. The proposal specifies the types of digital assets subject to reporting, including cryptocurrencies, stablecoins, and possibly other blockchain-based assets depending on their classification as securities or commodities. Moreover, it delineates the responsibilities of both individuals and intermediaries such as foreign exchanges and wallet providers.
